Question about waitting I485?

OPT will expire soon. I have applied I-485 by dependent my HB. He applied I-140 and I-485 currently.
My question is
1. Am I ok for legally status for staying USA after my OPT expire?
2. If my HB's I-140 is refused, does that mean I am out of my legally status immeditally or I still can legally stay here as the waitting for 1-485?
