Please help, accounting job Q!

I remember some one here said even $20K/year for an accounting position can apply for H1B. But my lawyer told me I need $42K/year to be eligible. Is that true? I got an accounting bachelor degree from China.

Please give me an answer ASAP. I'm negotiating with the company. Thank you very much!
