Yes, you are no longer H4 if you used EAD. If you GC based on EB3 is denied, you will be out of status. You must apply for a new H4 abroad.

For your hu*****and's case, you don't need to do anything if he only files I-140. If he will file both I-140 and I-485, just includes you as a family member.
