I am in the same boat with you. Because your kid did not apply for AP before returning China, his 485 application will be invalid, even if it was approved recently. I have no time to get my kid here to file 485 before my case was approved. So I just filed a I-824 form to USCIS and wish to get the kid back ASAP. Your lawyer should be familiar with this form. Other wise you should hire a Chinese lawyer. Good luck.
