inquire about I-140

Dear All,

I have two questions for you:

1) I am currently holding H4 visa, and my hu*****and are holding H1B visa. I just filed out my F-1 status
changing request for 2 weeks, Could my hu*****and submit his I-140 green card application at present?

2)After my hu*****and files his I-140 out, could he go back to China and get his H1B visa back earsier?
