H1 transfer 的名额问题

不占名额的非赢利(如大学)的H1 办transfer到赢利的公司,到底占不占名额? 有的律师说占, 有的说不占(说名额只对申请新的H1有限制, 只要有了H1, 无论是占名额还是不占名额,和新的名额就没关系了),很担心这个问题.

请有次经验的朋友说说, 或告知到哪儿能找到法律依据.
