request help urgently

My application of I-140 was denied on Dec. 2, 2004. However, we knew that just last week, which has passed the appearl time (Jan. 2, 2005).

My lawyer and I had not gotten any informaiton from US CIS since we submitted my application documents to them even if we called USINS several times and wrote them several times. When I called USCIS, they always told me that you should wait one month to get informtion, if not, another month. I called them once a month since last Nov. and my lawyer also helped me call them several times. We had not gotten any informaiton from USCIS. Also, the informaiton on USCIS online is always same.

Based on the information above, Would you please give me some advice that there is something that I can do next step? Thanks
