H1 is easier.
EAD based on I-485 pending is cancelled the same day I-485 rejection. If unlucky, EB1 I-140 may be rejected (so will the I-485) in 6 to 12 months, and you must leave US unless you are eligible to file another I-485 (based on another category) immediately.
