About the cut_off date, is that your mean is the visa backlog? If that is it, it is holding you file 485 not 140. I do not know any limitation on file 140 with an approval lc or subsituted lc or some of case not require lc.

about cannot file 485 because of visa backlog for people from CHINA, INDIAN and PHILIPINS, AC21 104(c) declare that you can get extend h-1b 3 years per extend
