140批了，485pending能不能填1040NR?

请问专家：

我在2004年I-140批下来了。同年(2004)我递交了I-485。但是
我的I-485仍然在排队等候。

我的问题是：2004年的税，我能不能使用1040NR并且使用
treaty? 如果我使用1040NR表会不会对我今后调整身份产
生影响？
