H1b holder is allowed to have immigration intent. Many H1 holders have successfully obtained their H1 visas after filing I485. There was a post inidicating that he got his H1 visa in Shanghai even after his I485 was approved. I don't see any problems with your H1 visa application if your spouse is a permanent resident. There may be other risks than your immigration intent.
