Can you go furthur to tell when my wife must start to work for the company? She is not on H-1B, nor has an EAD (she is on H-4). Actually we can think this is a bona fide application because the company does have intent to creat some work and a position, and officially hires my wife if she would like to work for them, but as I said we just wanted to bother them as little as we could. However if the law says she must work there at some point of time during the whole application time period from PERM labot cert. to I485, definitely she and the company can and will. So again when must she start to work? Must she apply for the EAD after filing 485 and then start to work for the company after receiving the EAD card or she can wait until the green card is received?
