F1 status

I am holding F1 visa now. My hu*****and and I filed I-140 & I-485 August 2003, and I-140 was approved Jan 2004. I never applied AP and EAD. Am I still legal in USA(as I-485 pending) if I quit from school now? I know the safer way is just to transfer to H4, but just want to find out what will happen if I don't change to H4. Thanks.
