Recently, US issued a new policy that if an H-1B holder got laid-off and he/she then, after a while got a new offer, they can apply for a new H-1b visa.But it is IRS's discretion to approve or reject.
I am in such a situation. I was wondering any one who's a lawyer or has this kind of experience might want to help me?
How long is this interval usually allowed?
If rejected, would IRS then demand the person to leave USA?
Any info would be apprecaited.
