you don't need to pay $1000 panalty since he is an immediate relative of U.S. citizen and he came to US legally. Very good chance he get status adjusted in U.S. In the unlikely situation the INS denies his adjustment applicaiton, they normally do not refere his case to immigraiton court. Depending on the grounds of denial, your parent can file another applcation to remedy.
