Dear Teacher8,
Our green cards were approved prematurely when the I-485 AOS priority date was not current as of approval date. We contacted congressman's office and they sent a congressional inquiry to USCIS. Yesterday we received Notice of Intent to Rescind (NOIR) letters from USCIS and they tell us the green card was approved in error. I expect another USCIS letter which will indicate the place where we can send GC back to them after 30 days.
Tomorrow I will be traveling to Europe and returning after one week.
Currently we have H1/H4, AP&EAD Combo and Green Card, all of them are not expired. I checked our I-485 status online is still "Card Was Mailed to Me" instead of "Case Reopened".
My question is what legal document (H1, GC or AP Combo card?) we should use in the Port of Entry when I enter into the U.S. Customs?
-You had better bring the green card, the AP/EAD combo card, and the employment verification letter from your employer with you. Then, only show the AP/EAD combo card to the immigration officer at the port of entry when you return to US. If the officer asks some questions about your status, just explain it to him/her (show the officer the green card, AP/EAD card and the employment verification letter if necessary in this case). If the offficer does not ask your question about your status after you show him/her the AP/EAD combo, then do not need to show the green card, etc. to him/her and say nothing.
Thank you very much!
