8老师您好，我想请教H4身份与F1身份转换期间有Gap是否存在任何风险。

背景：H4配偶已经递交H4 -> F1 COS并收到I797 approval notice， 假设797显示F1身份开始日期为8/30。假设H1B持有者工作将于8/1终止。请问：

- H4持有者是否可以用grace period来度过其中的Gap？可否不必离境？

-If your H-4 I-94 does not expire before your F-1 is effective on August 30, you can stay in US legally during the gap period of time even if your spouse (H-1 holder) lose the job. 

If your H-4 I-94 expires before F-1 is effective, technically you need to leave US and get the F-1 visa to come back. 

- 若不离境，H4配偶期间是否属于无合法身份，只是允许停留？-See above.

  -- 在现在的政策环境下有任何风险？-Do not see a problem.

  -- 目前来看，对未来绿卡申请是否会造成任何影响？-No.

- 传闻最近有给H1B被revoked的人发NTA的情况。H1B持有者是否应该和现雇主讨论，试图让现任雇主推迟递交H1B revocation。

-It does not hurt you to discuss with the employer to delay withdrawal of the H-1 petition.
