最近正在申请H1B和H4延期,结果发现小孩的I-94出了点问题。
小孩的I-94因为入境时护照过期时间(2023年6月1日)早于H4(过期时间2023年7月1日),所以I-94的过期时间就是2023年6月1日,与H4过期时间有一个月的gap。
现在律师说必须将I94过期时间更新到H4的过期时间,补好gap,才能file extension。原因是延期后的H4的I-94的start date会是2023年7月2日,于是小孩就会有一段非法停留期2023年6月1日 - 2023年7月2日,会影响将来申请绿卡。
-Not true. As long as your kid files the H-4 extension before his/her I-94 expires, he/she will be fine. So, no worrisome and just file your H-1 extension and your kid's H-4 extension at the same before June 1 (enure USCIS receive your H-1 and H-4 extension before June 1), it will be fine. Status gap is not equal to unlawful presence and also, even if the child has one-month iunlawful presence, it will not affect his/her green card applicaion if your green card application is employment- based category (i.e. you are the beneificiary of I-140).
但是我看到USCIS有说明,如果有pending的H4 extension case,I-94过期也可以合法留在境内的。这似乎跟律师讲的有冲突?请问小孩的I-94到底要不要先更新,再file extension?
-Your understanding is correct. Your kid has no unlawful presence if he/she files H-4 extension before June 1, so his/her green card applicaiton in the futrue will not be affected.
如果真的要更新I-94,是不是可以拿着新换的护照到local CBP办理,而不需要出入境?
-No. The CBP officer did not do anything wrong to issue your kid's I-94 duration which is shorter thna the H-4 approval notice due to your kid's passport validity problem, so they may not do it for you.. But your kid does not need to do it. anyway.
