US citizen filed I-485 for his foreign wife through a law office two months ago. Package was rejected and returned a few days ago due to form G-28 not filled properly. The law office messed up.
The wife's tourist visa is expiring in about 2 weeks. Unfortunately the lawyer passed away yestrday all of sudden. His assitant is working on the case. Hope to find another lawyer in the same group to correct and submit the package again ASAP.
My question: Will the wife be considered out of status and in trouble down the road. It takes 4 to 6 weeks for USCIS to open a package due to pandemic nowaday .But her visa will be expired by then.
She is so worried.
-Because the husband is a US citizen, his wife's green card approval will not be affected even if she is unlawfully present in US. So, no worrisom at all.
