8老师您好！我的2018年7月递交的NIW两年前获批，现在485排期到了。我目前在美国是O1签证，2022年2月到期。我计划今年年底回国工作两三年年，但也可能还要明年夏天回国。
1. 请教我这种情况，是等今年底回国后再从境外申请485, 还是现在就申请 485 + Advance Parole?
-You cannot file I-485 when you are present outside US. You had better file I-485 now and apply for advance parole at the same time and use AP to travel.
如果绿卡要一年才下来，我中间又离境，那我的485就作废了 （我曾经和EB1一起递交过485，2019年底还去移民局面试和交体检表了，但因那年夏天离境被否了）

2. 因为我也有可能要明年夏天才回国，我是不是在递交485时也要提交O1延期？还是递交了485后，就可以合法居留直到拿到绿卡，不需要O1了？
-You don't have to extend O1, but you need to have EAD to work. So, you had better apply for the EAD at the same time when you file I-485. The problem is that if your O1 expired before you get the EAD, then you must stop working. In these days, it takes a long time for EAD to be approved due to Covid 19. So, you may consider extending your O1.
3. 485排期到了之后，最多可以拖延多久file 485而不影响最终获得绿卡？
-You must file I-485 within one year from the date your priority date is current. Otherwise, your I-140 may be revoked.
