我给妹妹办移民，I130 approved。 2020年11月，case has been transferred to GuangZhou. 有两个问题请教8老师：

1. 我妹妹的女儿的名字加在I130上的，在NVC网上也有她的信息。但她现在已经超过21周岁，未婚，还可以和妹妹一起进行下一步吗？

-Depends. Calculate the child's CSPA age using this formula: 

CSPA age = the child actual age when the priority date is current (based on A Form in Visa Bulletin) - the I-130 pending dates

Note: I-130 pending date = I-130 approved date - I-130 receipt date

(I-130 approved = the I-130 approval notice issued date)

If the child's CSPA is less tha 21, then the child is not age-out and thus, the child can immigrate with the parent. Otherwise, the child cannot use the immigrant benefits as the parent's derivative.

下一步是缴费，但不确定女儿是不是可以一起缴费办理。

2. 我妹妹现在在中国，妹妹的女儿现在在美国境内，学生身份，用OPT工作。如果她可以和她妈妈一起办，她需要回国办理吗？还是可以在美国境内申请？

-Either way is OK if the child is not age-out. If the child wants to file I-485 within US, she ahs to keep the non-immigrant status such as F-1, H-1, until she files I-485. She cannot file I-485 until her mother enters US using the immigrant visa.
