一、申请资格与条件 

1、中华人民共和国公民，申请时持中华人民共和国有效因私护照；

2、来美途径属于留学；

3、在驻美使(领)馆教育处(组)有注册登记记录；

4、与国内原所在单位结清经济、住房等关系，并已协商解决其他未了事宜。

So if you think Chinese Embassy may waive your J-1 residency based on your marriage or some other bases, go ahead to apply.
