由于新冠病毒,公司多数员工停薪留职(temparal lay-off). 但我们部门,印度老板留下两个H1b小印继续工作(其中一位正在办绿卡),而让两位美籍国人停薪留职,请问各位大侠,从法律角度,这有什么问题吗?谢谢!

-H1B employees are TEMPORARY workers and should remain with the company only if there is a shortage of USA Citizen skilled employee. Therefore, technically H1B Visa employees should be cut before USA Citizen employees doing the same job. You can complain it to US Department of Labor if you want to. But the employer may not want to hire you back anymore if you fight him.
