请问8老师 给弟弟全家递交I-130后, 弟弟accidentally passed away. Can his daughter still eligible for immigration if the case approved?
-Depends on where his family members lived when your brother passed away. Based the immigration law, INA 204 (I), if his family members lived in US when your brother passed away and they are still living in US continually, then they may be qualified for I-485 filing when the priority date is current. If they lived outside US at that time, then they cannot use this immigration benefits.
