8 老师好！13年前withdraw 了 I - 485 并离开了美国。 现在能resume 吗？
我们一家三口在美时，2003年我先生以NIW（Idvi w/Adv Deg or Exceptional Ability in the National Interest) 申请了I - 140 和 I - 485。 之后 I -140 approved. I -485 pending.
2006 年，全家搬到香港，写信withdrew 了 我们三人的 I -485, 并得到了USCIA 的回复。
2014年，孩子去美念大学，目前OPT在加州一高科技公司工作。今年的H1没抽中。
问题，孩子可不可以续回13年前的I-485 pending? 这样可以省了H1 的申请吗? 我还留有当初的文件。
-All of the I-485 have been void due to withdrawal (equal to that you have never filed I-485). I don't know whether your spouse's approved I-140 is still valid or not. Based on the USCIS new rule effective in Jan. 2017, if you don't file I-485 within one year from the date your priority date is current, your I-140 will be revoked. So, your spouse had better contact USCIS to see whether your approved I-140 is still valid. If yes, he can come back to US to file his I-485 (he had better find a job in US), then your kid can file I-485 together with his I-485. Your kid cannot file I-485 without your spouse's I-485 filing. Important: he needs to have a job or a work plan in US. Otherwise, his I-485 may not be approved and thus, your kid's I-485 will also not be approved.
