does it matter when the kid gets adopted as the step child, say, after the immigration visa is approved? The kid now lives with her bio father.

-If the kid wants to immigrate to US before she turns 18 years, the kid's custody right has to be transferred to the mother and also, the biological father has to agree the kid immigrate to US with the mother. Otherwise, the child cannot get the immigrant visa.
