Under current USCIS management / leadership, this is not really a grey area, adjudicators should follow the director's instructions and give the favorable decision to HLOP visa status holders after entry with AP. What isn't stable is that it is subject to change anytime without any notice and no approval needed from OMB or Congress at all. It is internal.
