我的NIW 485等了很久都没有消息。我听说有时候因为种种原因或者是因为出错，NIW 485 有可能被拒。我想先作好准备如果万一NIW 485被据，及时appeal 或 motion to reopen，那么在appeal或motion to reopen期间，我该怎么保持身份？

我现在还在h1b extension期间，但是我用了AP回国，所以应该属于AOS. 

-Your status is Parolee if you use AP to travel, but you can still use the H-1 benefits. Thus, you don't need to  use EAD to work and you also can extend your H-1 or transfer H-1 to reinstate your H-1 status within US.
