老师您好！我2018年2月递了Eb1的140+485+ AP +EAD, 3月去USCIS采集了biometrics; 6月收到了AP+EAD, 但是都没用；7月递了NIW和O1, O1去年底批了。今年1月Eb1拒了，但是NIW的140批了，收到的USCIS 797上写的PD是2018年2月，而不是递交NIW的7月。今天收到了移民局的电邮关于我的485的通知“Case Was Received At My Local Office”。这样看来，我的485是否没有因为Eb1b被拒而失效了，而是随着NIW的批准还有效呢？我已经定了6月初暑假回国两个月的机票准备申请O1回来。我的Advance Parole是今年6/1过期，现在申请renew Advance Parole也来不及了吧？怎么办呢？我应该打电话给移民局问485到底是会被拒还是有效吗？恳求8老师指点。万分感谢
-The I-485 will be denied sooner or later because the EB1 I-140 was denied and NIW I-140 priority date is not currnet. But you still can use advance parole to travel before the I-485 is denied. You can go to the local USCIS Office to apply for emergency advance parole if you want to. Otherwise, you may apply for O-1 visa to come back, but this means you abandon your pending I-485.
By the way, if you use AP to travel, you will lose your O-1 status, and thus you have to use EAD to work, not O-1 status.
