非常感谢百忙之中这么详尽的解答！根据您的分析，看来如果听下一个律师建议放弃绿卡不是特别的方案。第一看来需要放弃绿卡后几年后才可以申请；
-His spouse can file I-130 immediately after he gives up the green card. But F2A category has 排期 which takes about 2 years and also the immigrant visa application processing may take several months to one year, so total about 2.5 to 3 years for him to get the green card again.

而且他太太转公民也是遥遥无期的事儿（他太太在美国呆的时间也不多，但是基本每3个月就过来一趟）。
-Then, his wife had better apply for reentry permit, otherwise she may have the same problem as him. The principle is that the green card is for you to live in US permanently, not for you to use it as a border-crossing card.


另外我想请问两个问题：1、这种motion for determination成功的几率多大，需要多长时间？
-It is hard to say, case by case. Probably it may take several months for the motion itself and plus the extra court time.

2、如果现在放弃绿卡您说需要在国外进行？在这边需要file一个什么东西来放弃吗？
-Nothing will be done within US. But because his green card has been taken away, I am not sure whether there is something different in his case. So, he had better consult an immigrant lawyer to see how to abandon it if he plans to give it up..

这样放弃对他不久的将来（比如今年下半年）申请美国旅游签证有什么影响吗？-It should not affect the B2 visa application.
