As to your second question, I think your LG needs to apply for H1B visa. I asked my immigration lawyer if I should work with H-1B or change to use EAD to work (still for the same company) when I got my EAD, he told me if I want to use AP to travel outside the US, or to change job later, or want to work for the second emplyer at the same time, I must use EAD;If I have dependents who are outside in the US and need to apply for H-4 visa to enter the US, I still need to keep my H-1B status. Back to your question here. Your hu*****and will use AP to travel outside the US, so he will lose his H-1B status (I guess he like most of us here changed his status to H-1B after he got his job). However, your kid needs to apply for H-4 visa, so you hu*****and should resume his H-1B status to support your kid for H-4 visa application. Therefore, your LG should apply for H-1B visa.
