我朋友去年140和485一起交的，他也使用了EAD和AP。最近他收到140RFE,他怕140 被拒失去身份，所以想申请O1。
1. 485pending期间他可以申请O1吗？
-Because he has no legal non-immigrant status after he used EAD to work, he cannot change status to O-1 within US.
2. 只要在140悲剧之前交O1 的申请就可以吧？配偶和孩子也是AOS身份，能交I-539转O3吗？

3. 如果当前140悲剧，可以在O1 pending 期间交新的140和485吗？
-Technically yes for I-140, but no for I-485 because he has no valid non-immigrant status.
4. 如果140 悲剧，他还没来得及交O1，是不是他就只能回国？
-He has to leave US after the I-485 is denied.
5. 如果140 被拒，他回国后可不可以在国内的领事馆申请O1签证呀？
-Yes.
会不会说他有移民倾向呀？
-No problem because practically O-1 visa/status is considered as dual intent (i.e. allow to have immigrant intent, similar to H-1/L-1). But if he leaves US to get the O-1 visa during the I-485 pending, then his I-485 will be invalid.
If his I-485 is denied, he can go to China to get the O-1 visa to come back.
