8老师, 485 收到 Request for evidence from USCIS as below:

A review of your file and USCIS records indicates that you were physically present in the United States prior to your last admission. Submit evidence to establish that you did not accrue unlawful presence beginning on May 2008 and ending on October 5, 2010; and beginning from April 15, 2011 and ending on January 10, 2012. This evidence may include the following:

  1. Proof of lawful status or as a parolee;
  2. Proof that you did not accrue unlawful presence because of statute;
  3. Proof that you did not accrue unlawful presence because of USCIS policy.

 

Question: 1.“last admission" 是不是指 最近一次的入境?

-Yes.

 2. 这个proof of evidence是要提供 在那时间段的 H1B 的approval notice 即可?

-Yes and the I-94, visa stamp page from your passport. It seems this IO is not professional/experienced. It is ridiculous to ask you to provide your status proof before your last entry. But just provide it to them if you have, anyway. If you do not keep such documents (i.e. lost), then you just explain it to them that you lost the documents and also, based on the immigrantion law, you should not need to proivde such documents for your I-485.
