I am Canadian, working in US with L VISA. My L VISA is about to expire in 2 months. After my L VISA expires, my company decides to sponsor me for TN VISA. As I know, TN VISA beneficiary should have no immigrant intend, and I think that I can prove that since I have been in US for 7 years, but I did not ask for green card.

However, when my wife works under L2, her employer sponsored her for green card with I-140 approved.

My question is, when my wife applies for TD VISA, can USCIS or CBP denies her since she has approved I-140?

-Normally no. USCIS has a special polcy that I-140 filing or approval itself does not affect TN or TS application.
