8 老师， 您好！我有几个关于H1b transfer 的问题想向您请教。 我查过以前的帖子，您帮助解答过类似的问题，但因为挺不容易找到这个新的工作， 不想出错， 所以麻烦您帮忙看一下:
我的情况是：我前一阵被layoff，公司给了一个多月时间通知我，说在5月初的时候会withdraw 我的H1B. 因为一直没有找到工作， 我在layoff date （5月初）之前一周交了I-539 申请转B2, 已经收到了receipt。 现在有一家公司给了offer，准备办H1B transfer。我的问题是：
- 因为从layoff date 到 现在有两周，是不是必须要告诉公司的律师我的B2 的申请，给他我的receipt number?-Not necessary, but it does not matter. 这个在我的H1B transfer 的申请中有什么作用？-If your B-2 is approved after the H-1 approval, then your B-2 will override the H-1, thus you need to go to China to get the H-1 visa to come back.
- 如果公司用了premium processing service， 而且USCIS 批准了H1b transfer， 并给了I-94,是不是我就不用出境，拿到H1B 的那天就可以开始工作了？-Right. But if your B-2 is approved later,, then see above.
- 连接上个问题，如果我拿到了I-94, 不出境，我是不是要马上递交withdraw B2 的申请？-Beucase it is very short time (within 30 days) for you to find a new job after your layoff, you may just withdraw the B-2 application after you file H-1 using premium processing in case the B-2 approval override your H-1 approval. 这个过程是怎么样的呢？- Write a letter to request withdrawal of B-2 (provide the coy of the B-2 receipt notice). 我查了一下，好象我需要写封信说明情况，还有withdraw也需要一段时间。现在网上说转B2有很长时间的pending， 是不是withdraw 的审批要快一些？大概需要多久呢？如果在B2 approve 之前withdraw 了，是不是目前就没有什么问题了？ 但因为withdraw 了b2， 从我的layoff date 到 收到h1b transfer的receipt number 或是approval（即使用premium processing service, 是不是也应该先有个receipt-Yes.,还是直接15天就告诉结果？）， 就是空窗期，以后申请绿卡或其他签证就会有麻烦？-No.
- 如果USCIS 没有给I-94, 我是不是就要出境?-Yes.那我B2 申请会怎么样，我需要做什么?-Withdraw it or it will be void automatically after you leave US.
