-Not at all! This lawyer is very inexperienced. An approved I-140 is practically valid forever as long as the employer does not withdraw it and still will provide the same PERM position to you. But if you want to apply for the immigtant visa outside US, you need to ask your employer to file I-824 to request USCIS forward the approved I-140 to NVC, then you have to apply for the immigrant visa within one year, otherwise, the I-140 will be considered abandoned.
Of course, because the I-140 PD is current, you may only can get the H-1 for one year, not three years.
