8老师，您好。我有一个棘手的问题是关于我儿子由F2转F1. 我本人目前博士在读，我的I-20今年五月30号到期，正在申请延期一年毕业。我儿子在美国高中最后一学期，持F2签证，已经收到大学录取通知书秋季入学。我有几个问题想向您请教： 1. 我的I-20延期，他的I-20会随我一起延期一年。这会对他申请身份转换有什麽影响吗？

-No.

2. 我们来美国已经8年了，这八年期间，他从来没有回过中国，这对他申请身份转换有影响吗？

-No.

3。 他在中国还是在美国申请F1 Visa? 如果在美国申请，我们应该注意什么？如果回中国申请，有什麽风险吗？

-Either. He can file I-539 to change F-2 to F-1 within US. Talk to the University/College for help for his change of status. He can file I-539 as long as he gets the I-20.

8老师，您好。还有一个疑问，如果我儿子拿到他的F1 I-20，他可以合法呆在美国吗？ 谢谢您。

-Yes. Before the F-1 status is  effective (the effective date is on the I-20), his status is still F-2. He needs to get the I-539 aprpoval from USCIS before he enrolls the University/College.
