refusal-green card

Dear 8 老师：

Can I consult you? My husband's green card application at Guangzhou, China has been refused and the reason is that he is a Communist party member (共产党员). WE have waited since May 2013. 

Now, they suggest that my husband can apply for waiver at USCIS. 

In our thinking, can my husband apply for B2 visa in China in his current status of green card refusal? If he can't apply for B2,  would you kindly provide us the information on how to apply for waiver at USCIS?
