我老公一直是H1，我从今年4月H4 转H1。

最近劳工收到intention to revoke H1, 规定一个月内提供所有材料，他们再决定是否revoke他的H1。
-I am curious why SCIS want to revoke the H-1 after it has been approved for such a long time. Did the employer not pay him prevail salary or your spouse did not work at the working site indicated in the H-1 petition?

递交补充材料到最终决定，大概需要多长时间？
-Normally they will continue the case process immediately after they receive the response to the RFE.

很大的可能性他的H1会revoke, 如果这样的话，是不是绿卡也一定被否决？
-Irrelevant.

我们还有必要去Finger Print吗？
-Yes.

如果他的H1被revoke, 我查了一下，revoke 的时间会是批准H1的时间，他的H1最初在08年开始办，去年8月EXTENSION，那么revoke的时间会是08年还是去年？
-It should be his approved current H-1 petition (filed in last August).

如果这样，我和他变成很长时间的out of status or illegal stay? 他是不是需要立刻离境，
-No. Unless the H-1 petition  has fraud, his H1 status will be invalid on the day the H-1 is revoked (if it happens). He does not need to leave US because he has a pending I-485, but he has to stop working with H-1 status if the  H-1 is revoked. He needs to file I-765 application for EAD and use EAD to work. He may also file I-131 for advance parole (AP), and use AP to travel (if any). There is not fee (it is free) for I-765 or I-131 filing fee by providing the I-485 receipt.

我的H1是不是同时失效，需要立刻离境？
-No. Irrelevant t your status.

如果我还可以继续H1，我以后是不是还是需要离境入境去消除out of status, 这样才能申请绿卡，成功地几率有多大？
如果老公离境后，是不是很难再入境？
-No. See above.

是不是10年内不能帮他申
