背景信息：
本人，美国公民，离异，居住在芝加哥的西北郊。
未婚妻/女朋友，是中国公民， 离异带有一小孩（今年2月份刚满19 周岁，未婚在读）

未婚妻/女朋友是本人的中学同学。去年5月份开始互有好感发展成恋人。今年一月份本人回国和她相聚过一次。随后5月份/6月份她到美国来和我又相聚过半个月。现在我们准备通过婚姻结合在一起。未婚妻/女朋友现在还在国内工作。她的小孩正准备申请来美读书（想在明年的秋季入学）。

女朋友/未婚妻： 之前来度过美国多次 （商务及旅游）。先持有10年有效期的旅游签证。她的小孩从未申请/来过美国。

原本的计划及打算：
我们原本的打算 （现在看上去十分的不靠谱 ）如下：

今年9/10月份，女朋友/未婚妻用现有的旅游签证来美国和我结婚。计划在美国呆2-3星期，完婚后回国 （因她还有工作未结束，小孩还在就学）。到明年5/6月份，把手头的工作结束然后来美国和我相聚（打算长期居住下来，同时申请绿卡）。 她的小孩计划是申请F1签证明年秋季入学。


问题：
1） 网上初步了解了一下：如果女朋友/未婚妻以旅游签证入境和我登记完婚，即使只是在美国呆了2-3星期，也可能会被认定visa fraud。是这样吗？
-Don't think so because she does not intend to immigrate into US at present (she will return to China after you get married).

2） 同时她的小孩在申请F1签证是很有可能被认定有移民倾向而被拒绝，我的理解对吗？
-No. Irrelevant to the child (not affect the child F-1 visa application).

3）如果替未婚妻和她的小孩申请 K-1 和K-2 签证。时间大约是多长？
-May take about 6 months or more, case by case.

在等待K-1的过程中，未婚妻是否可以用原有的旅游签证到美国来短期和我团聚，而不影响她的K-1 申请？
-Fine.

我和未婚妻完婚后替她们申请绿卡需要多久时间可以拿到？
-If she uses K-1 visa to enter US, you can marry her immediately (must get married within 90 days), and you can sponsor her green card immediately if you want to. But because the child is > 18 when you marry the child's mother, you can not sponsor the child green card directly, and that means if the mother use B-2 visa to enter US to marry you, the child can not get the green card from your marriage, and it is the same result if you marry the mother in China. But I am not sure whether the child can apply for green card together with the mother as the mother's derivative if the mother uses K-1 visa and the child uses K-2 visa to enter US together. So, I suggest you to consult an experienced immigration lawyer for this issue.



她的小孩以K-2签证进入美国后是否不影响她的就学申请/入学？
-No problem.

4）如果我去国内和她完婚，我是否只能替她们申请 K-3 和K-4签证？K-3和K-4的时间是多久？
-Case by case, normally it may take about 6 months or more.

这样的话，她的小孩就无法随她一起申请绿卡？必须在她本人拿到绿卡后，再为其小孩申请绿卡？
-Right because the child is > 18 when you marry the mother (see above answer).
