情况是这样：2007年到２０１３年一直用TN在A公司工作，2011年申请了PERM和 I１４０（２０１２年批准），2０１３年申请了H１B并抽中， 因layoff, 没有去边境激活H１B；2014年初去了B公司，半年后回到A公司，工作地点在外州。　刚换了３年的TN，排期下个月current。 现在公司有意提供H１B　Amendment， 　有３个疑问：


１.　一般情况下，H1B Amendment 需要多长时间可以得到USCIS批准？
-It normally takes about 3 months, but your employer can use premium processing to get it approved in 15 days.


2.　如果提交I４８５时的状态是H1B，万一I４８５被据，以后还能申请TN吗（这样的情况是否被认为有移民倾向而不能再申请TN）？
-No. After you filed I-485, you can not get the TN anymore due to immigration intent.


3.　如果既能够在TN状态下提交I４８５，也能够在H１B状态下提交I４８５，请８老师给个建议，哪种状态下提交为好。
-It is not different. I-485 filing does not affect your pre-existed TN status. Also, you change your TN status to H-1B any time before or after you file I-485. File your I-485 the sooner, the better if the PD is current in case the PD becomes not current again.
