B1/B2签证 --计算在 2年J1归国服务期当?

 

 My situation is

(1) 2007-2012 USA, J1

(2) 2012.6- 2014.2   China (20 month)

(3) 2014.2- 2014.8   USA, B2  (6 month)

(4) 2014.8-now  USA  H4   (8 month until now)

 

We thought B2 visa stay time is also counted into 2 years rule of J1, so we got h4 visa. 

In this situation, can I file 485 with my husband?

Li Qingmin: 尊敬的签证官，您好！J1身份赴美，适用 2年归国服务的限制。回国后又申请B1/B2签证去美国开会，或 F2探亲，回国服务 2年的时间起始点是否将从持B1/B2签证或 F2签证回国后的日期开始重新计算 2年的时间。换句话说B1/B2签证或 F2签证短期赴美的时间是否计算在 2年归国服务期当中。谢谢！
