Next month my case(NIW) will be current. My husband works in China and visits us several times a year. Can he submit I-485 with us if he come here next month?
-Depends on what kind of visa he uses to enter US. If he uses H-1/H-4 or L-1/L-2 visa to enter US, it is fine to file I-485 immediately. But if he uses B-1/B-2 visa, then he had better wait for about 3 months to file I-485 in case USCIS consider it as visa fraud.
If yes, he must stay here until the fingerprint get approved, is it right?
-Had better do the fingerprint before leaving. Also he needs to apply for AP to travel unless he has H-1/H-4 or L-1/L-2 status.
