我现在的雇主已申请破产,实际雇佣最多至下周三。有一个offer A已拿到LCA, 最快下周三之前能把petition发出去。我更想去的一个offer B估计下周内也能拿到手,雇主希望越早报到越好,最晚不能迟于12月中旬,可是要等offer到手之后才能开始申请h1b transfer.
那么我现在该如何选择?
1. 如果现在的雇主同意保留至11月底前才算termination, 但是paycheck上肯定金额不是full pay, 这样做可以吗?offer B 肯定能在11月底前发出petition 如果一切顺利的话。 那么我提交的三个月工资单就是8,9,10三个月,这完全没问题。

2. 先用offer A 申请transfer, 走premium processing 一旦拿到approval后马上提交offer B 的申请进去,这样的话身份上一直都合法。但由于要等offer B批准后才能申请后一个,时间上会比1.慢些。

3. 干脆 out of status, 直接申请转offer B, 批准后再入职。风险最大。
