H1B签证，I-140 已批准，I-485尚未递交，现在在转工作，新公司答应帮助转签证并递交新的I-140，priority date 应该不会丢失。我的问题是：如果11月转签证成功，可以11月底就从老公司辞职，12月修整一个月，1月再去新公司上班吗？感觉比较累，想休息一下再上班，不知是否合法。
-You may ask your new employer files H-1 transfer on Later in the early next month (not use premium process), then you can take December off, and work in Jan. for the new employer. You are legal to stay home or work for the new employer during the H-1 transfer pending (not need to wait for H-1 transfer approval to work for the new employer).
