老公h1b三个月前6年期满，学校帮他申请o1 签证，并说等签证期间可以继续工作。最近结果出来o1被拒了，所以相当于三个多月他在美国都没身份，现在他打算回国签证，可以签 h4(因为我是h1), 或者签 j1(学校支持的）。我想问像这种有一段时间在美没身份停留的，回国再签还有希望签过吗？
-If he filed O-1 application before H-1 expired, he was legally present during the O-1 pending. So, as long as he will go to China very soon, he should be fine to get the visa. Bring the last H-1 approval notice and the O-1 denial notice to prove his legal stay during the O-1 pending during the visa interview.

签过了的话入关有问题吗？ 如果有可能，是签h4 还是j1 好？
-H-4 visa is easier to get than J-1 visa (he can change H-4 to J-1 within US later).
