我的H1-B和他的都是9月14号到期，我打算他走之后就开始提交延期我的H1和他的H4，希望9月份过期前能批下来。他计划7月底回来，理论上我的H1和他的H4都还没到期，我的问题是他下个月在国内签H4时会不会因为快到期了，或者已经提交延期但是还没批准延期而受影响？
-Because he will go to China, it is useless to file H-4 extension (just waste money). He just needs to use your H-1 approval notice to get the H-4 visa and enter US. So, you have to have a valid H-1 approval for him to get the H-4 visa and enter US. Of course, his leaving does not affect your H-1 extension approval (irrelevant). If he uses your current H-1 approval to enter US, he may file H-4 extension after he comes back. If he does not extend his H-4, his status will be AOS (legal stay and study in US, and wait for the I-485 approval).

If necessary, you may consider to use premium processing to get your H-1 approved and mail the new approval notice to him to get the H-4 visa and return to US. Thus, he does not need to file the H-4 extension after he comes back.
