如果为身在国外的副申请人（孩子）在排期当前时，递交I -824后，他用H4入境了，但却超龄不能再延期H4，请问副申请人这时的身
份状况？
-That will be a problem and he may need to go to China to wait  and apply for the immigration visa to come back.

是和递交I -485一样进入AOS状况吗？
-He can not file I-485 if his CSPA age is > 21. If his CSPA age  is less than 21 and the PD is current, he can file I-485 even if you have filed I-824 for him.
