8老师，律师把我的perm原件弄丢了（perm有效期为11/15/3013 - 5/14/2014, eb3, PD not current）。 在1/15/14，我交了I-140，由于没有原件，按照您上次的建议，在140申请中请求USCIS向DOL重新提供perm原件。

今天律师来信（我在下面copy了律师的信），说lost perm is recovered (由于律师说之前弄丢是由于他们把我的perm误寄到vermont center，今天的email里他们也并没有说recovered perm是vermont center 返给他们的，还是说DOL已经重新发了perm).

我的问题是：

1。 律师说尽管已经递交了一个I-140, 现在可以在5/14/2014前再交一个I-140,并且premium process. 这个说法对不对？
-Not necessary. Actually you don't need to file a new I-140, especially your employer will not pay the I-140 filing fee. You don't need to provide the PERM certificate and USCIS should have it on their system. If USCIS did not have it, they may have sent you RFE for it already or will send you RFE for it later.

If you don't need the approved I-140 for H-1 extension beyond the 6 year limitation, you may not need premium processing. If you have to use premium processing, just file I-907 with the filing fee of $1225 for premium processing of your current pending I-140.


这对我之前的I-140有什么影响吗？

2。一般的lost perm recover步骤是怎样的?

3。 如果recovered perm是vermont center return给律师的，
-I don't understand who sent it to VSC mistakenly, your lawyer?

或者是DOL重新issue的perm，这两种不同的scenario对我的下一步做法有什么区别吗？
-Originally I suggested you to file I-140 (a few months ago) without the hard copy of PERM approval certificate and asked USCIS to retrieve the duplicate  of PERM Approval from DOL (i.e. DOL to USCIS directly). It seems USCIS have done it for you, otherwise they may have rejected your I-140 or send you RFE for it already. So, I don't think you need to worry about it.
You may just ask the lawyer to contact USCIS to see whether your employer have provided all the required documents if you worry about it too much.

USCIS has returned to our office the original Certified ETA9089 that was in advertently sent to the Vermont Service Center. At this time, please let us know if you would like to submit a new I-140 filing to request premium processing. If so, we will send the original Certified ETA9089 to HR contact to obtain yours and her' signatures.

Even though an I-140 has already been filed, if you would like to submit a new I-140 with premium processing, the attorneys recommend we submit the request to USCIS in advance of the labor certification application expiration of 05/14/2014
