老公现在用H1为A公司工作,有效期至10月31号,A公司为他申请了EB2 perm,140已经批准,但是排期未到。他作为我的dependant (NIW)递交了485,所以有了EAD. 去年8月他用EAD为B公司工作了3天,
请问:
1. 他的current Non-immigrant Status是什么?(AOS?)
-Technically after he used EAD, he lost his H-1 status. But most likely USCIS does not realize he used EAD, So, he may just renew his H-1 before it expires.
2. 他的身份违例吗?(用H1为A公司工作期间,用EAD为B公司兼职)
-No because he has EAD, so you are legal to work.
3.需要通知公司他的身份状态已经更改吗?(H1---EAD)
-Do nothing.
4. 需要向公司或者USCIS提供什么证据证明他的身份状态已经在去年8月更改了吗?(开始使用EAD的时候)
-Do nothing. For 100% safety, he had better renew his EAD again and again (no fee, anyway) to keep a valid EAD all the time until his I-485 is approved.
5. 他想继续作A公司的工作直到合约期满(11月),同时兼职作自己的公司(自雇),合法吗?
-Yes, but he had better keep a full-time job at the same time in case USCIS check your employment status for I-485 approval.
